Procedural Rights of Parties and Legal Representation in Georgian Courts
Three proceedings, three rule sets
Civil disputes follow the Civil Procedure Code, administrative ones the Administrative Procedure Code, criminal ones the Criminal Procedure Code. The Civil Procedure Code itself contains exceptions for administrative cases (Article 450), so rules are not transferred automatically.
See our civil, administrative and criminal practice.
A party's rights
In criminal proceedings a party may file motions and obtain, present and examine evidence (Article 9), and gathering evidence is the parties' task (Article 25). The defence side includes the accused and his advocate (Article 3).
Fair-trial guarantees are protected by the European Convention and the Constitution; practice is in the Supreme Court and Constitutional Court databases.
Representative and power of attorney
Under the Law on Lawyers a lawyer works under a contract and must present a power of attorney or client order (Article 19). List each procedural act expressly and check the current rule in the procedure code: defective authority can expose a decisive step to challenge.
The Members Registry and Ethics Commission help verify status; legal aid is available only on limited terms. Confidentiality standards appear in the UN Basic Principles; ethics and disciplinary rules are collected in a Council of Europe compilation and discussed at a round table; see also the Georgian Bar Association.
